Judge Declares Bill Cosby a 'Sexually Violent Predator'

That first trial ended up with a mis-trial, but a second trial, in April, saw him convicted of three counts of aggravated sexual assault.

As the Commonwealth of Pennsylvania pointed out in their sentencing memorandum asking for the maximum prison time, "These assaults spanned decades and demonstrate an ingrained pattern of criminality". The defense wanted Cosby sent home on house arrest.

"Now, nearly 15 years later, I'm a middle-aged woman who's been stuck in a holding pattern for most of her adult life, unable to heal fully or to move forward".

During victim impact statements on Monday, Constand's mother told the court that her family feels vindicated. And no one should be treated disproportionately because of who they are, where they live, or even their wealth, celebrity or philanthropy.I am not permitted to treat him any differently because of who he is, or who he was.It is time for justice.

Judge Steven O'Neill made the determination Tuesday after hearing expert testimony and arguments from the state and Cosby's lawyers.

In June 2017, Ms Constand described how Cosby, whom she viewed as a "mentor", gave her pills that left her "frozen" and unable to stop his assault.

Arguing over Cosby being ruled as a sexually violent predator, his counsel conveyed it to the judge that Pennsylvania's sex-offender law remains unconstitutional despite several revisions on sexually violent predator designation. Neighbors and schools will be notified of his address and crimes.

Cosby's lawyers asked for house arrest, saying Cosby, who is legally blind and walks with a cane, is too old and vulnerable to do time in prison.

Constand stood at Steele's side but shook her head to say she had no comment.

The proceedings took place as women and others across the USA protested against Supreme Court nominee Brett Kavanaugh, who faces allegations of sexual misconduct by two women.

When the ruling came down, a woman in courtroom shot her fist into the air and whispered, "Yessss!"

For his part, Cosby did not make a statement to the court. "Unfortunately, all we can do is hold the perpetrator accountable", said Gianna Constand, the trial victim's mother, who testified Monday that her daughter's buoyant personality was forever changed after the attack.

"When the sexual assault happened, I was a young woman brimming with confidence and looking forward to a future bright with possibilities", she wrote in her five-page statement.

"Now, nearly 15 years later, I'm a middle-aged woman who's been stuck in a holding pattern for most of her adult life, unable to heal fully or to move forward".

Rosie O'Donnell thanked Cosby's accuser, Andrea Constand, for speaking up. He will also be required to pay a fine and court costs. He considers the case weak, citing the yearlong delay, Constand's continued contact with Cosby, and the failure of other accusers now coming forward to have ever filed a police complaint.
